General Terms and Conditions for using the Platform - B2B Webshop

I.              Terms for access and use of the platdorm

1. The digital platform B2B Webshop for online sales is intended for use only by distributors of Wienerberger EOOD, UIC 131343496 or other companies of the Wienerberger group. The platform will be available only to distributors with whom there is a Distribution Agreement between the distributor, in his capacity as a Buyer and Wienerberger EOOD, in his capacity as a Seller, on the basis of which the respective distributor has the right to purchase from  the materials of Wienerberger EOOD and the companies of the Wienerberger Group. 

II. Campaign organizer

2. This campaign is organized and conducted by Wienerberger EOOD, UIC 131343496, hereafter called "Organizer" and / or "Wienerberger".

III. Mechanism for using the platform

3. The respective distributor will also receive from Wienerberger a special account for access, through which he will be able to log in and manage his orders to Wienerberger. The B2B Webshop Platform will be connected directly to Wienerberger’s SAP order processing and invoicing system and will digitize and automate the process of sending and receiving requests, preparation of supporting documentation and automation of notifications and document reports.
4. By receiving an access account, each distributor accepts these General Terms and Conditions and undertakes to keep their provisions. Insofar as only distributors have access to this platform, based on the Distribution Agreement concluded between them and Wienerberger, all provisions of this Distribution Agreement apply in full regarding the use of the B2B Webshop Platform.

IV. Liability

5. Wienerberger is not responsible for technical problems related to the inability to access the platform, including technical problems.
6. Distributors are informed that Wienerberger's B2B Webshop Platform may be subject to attack and malicious influence by third parties that are likely to damage, disturb or otherwise adversely affect the functional suitability of the platform and / or parts thereof. cannot assume any responsibility if, as a result of such attacks and/or malicious influences on the part of third parties or any adverse consequences that might occur.
7. Wienerberger is not responsible to distributors who have delayed, made impossible or unsuccessful attempts to participate due to technical problems with communication systems.
8. These Terms and Conditions apply only to the use of the B2B Webshop Platform described therein and apply for the period of its validity. All other promotions, games and raffles organized by Wienerberger will be regulate by another terms and conditions.
9. Wienerberger reserves the right to change these terms and conditions.
10. Wienerberger has the irreversible right to terminate the use of the platform in case of material abuse, violation of these terms and conditions or
    force majeure circumstances in these cases no compensation is due to the distributors.  Wienerberger may but is not obliged to state publicly the reasons for termination.
11. In case of abuse, breach of an obligation or violation of these terms and conditions by a distributor, the Organizer has the right to disqualify him.

V. Personal Data Protection

12. The protection of your personal data is extremely important to us. Wienerberger Ltd. processes your personal data in accordance with the Personal Data Protection Act, the General Data Protection Regulation (EU) 2016/679 ("GDPR"), as well as the applicable European and Bulgarian legislation. We strive to be as clear, specific, and transparent as possible in the information regarding the processing of your personal data.
13. For the purposes of using the platform, Wienerberger EOOD will process the following types of personal data that are entirely voluntarily provided by you, initially in the Distribution Contracts concluded, and the following personal data are provided and will be processed for the use of the platform: 

• Name and surname of the account user
• Name of the distributor's legal entity
• Official address of correspondence
• Address of distributor's warehouses
• Name and surname of the persons managing the distributor's sub-accounts

14. In certain cases, Wienerberger may disclose the personal data provided to its contractual partners, e.g. to companies providing courier services and deliveries.  Your data is also considered confidential for our partners.
15. For the purposes of this campaign, Wienerberger EOOD will not transfer data to countries out of the EU.
16. Online access to the Wienerberger EOOD platform may connect you to other social networks such as Facebook, LinkedIn, YouTube, Twitter and others, and Wienerberger Ltd.  is not responsible for the protection of your personal data when accepting the general terms and conditions of these sites. In such cases, you should familiarize yourself in detail with the general terms and conditions of the respective sites.
17. 18. Wienerberger is not responsible for any computer attacks that may lead to the disclosure of data to distributors.
19. Each distributor has given its agreement to receive commercial communications from Wienerberger EOOD. Each distributor may at any time refuse to further receive electronic communication from Wienerberger. Up to the proper and unambiguously right, any such communication shall not be considered unsolicited by extension. of art. 6 of the Law for Electronic Commerce regardless of whether its recipient is included in the prohibition list under art. 6 paragraph 2 of the Law for Electronic Commerce

These terms and conditions have been approved by the management of Wienerberger EOOD on 30.11.2022.

These Terms and Conditions have the character of General Terms and Conditions within the meaning of art. 298 of the Law of Commerce By posting a comment, it is considered that each distributor has read, understood, and accepted each and all of these General Terms and Conditions.
